本文通过对我国商业银行破产处置的历史实践与现行立法进行分析,厘清了我国商业银行破产处置权力配置的现状,并检讨目前商业银行破产风险处置权力配置在授权依据、职责边界、分工协同和制约监督等方面存在的问题。本文还对后危机时代商业银行破产风险处置国际最新立法动态与实践进行分析,并围绕处置权力的种类、内容、属性、监督与救济等方面,提出优化我国商业银行破产风险处置权力配置的若干建议。

Based on the historical practice of the handling of bankruptcy risk of commercial banks in China, this paper clarifies the present situation of the bankruptcy risk resolution of commercial banks, and reviews the authorization basis, the boundary of duties, division of duties and supervision of the bankruptcy risk resolution in commercial banks and other problems. This paper analyzes the practice of bankruptcy risk resolution of international commercial banks before and after the 2008 financial crisis by combing the latest international legislative developments of bankruptcy risk resolution in the post-crisis era. It also puts forward suggestions on how to optimize the division of powers in China＇s commercial bank bankruptcy risk resolution in terms of types, contents, attributes, supervision and relieves
