Basic Rules of Patent Operation: A Multi-case Study

从专利运营的主体、客体和形式3个角度对专利运营的内涵进行分析,并给出专利运营的概念.通过对高智、佳能、高通、盛知华和智谷的案例分析,总结出专利运营的5个基本规律:数量规模规律、能人黏着规律、资金密集规律、产业特化规律和法律依存规律.最后,结合我国专利运营的现状,根据上述发现的5个规律提出促进我国开展专利运营的政策建议.

The connotation of patent was analyzed from the aspects of subject, object and form, and the concept of patent operation was put forward. With the multi-case study of Intellectual Ventures, Canon, Qualcomm, Sinoipro and Zhigu, the following rules of patent operation are summarized： quantity scale, talented dependence, capital intension, industrial specialization and legal environment dependence. Eventually, policy recommendations on promoting the de- velopment of patent operation in China were provided according to the five basic rules.
