“一带一路”战略下我国企业海外能源投资环保法律规制研究

Environmental Regulations of the Overseas Energy Investment of China's Enterprises in the Light of“One Belt and One Road”

"一带一路"战略的实施,为我国企业进行海外投资创造了良好的政治、经济条件,越来越多的能源投资企业开始走向海外,其在促进东道国经济发展的同时,也会给东道国的生态环境造成一定的影响,如果不注意对东道国环境的保护,可能引发与当地居民关系紧张和冲突,不利于我国能源投资企业在海外的长期发展。当前对于海外能源投资的环境保护,我国企业承担着国内法、东道国环境保护法以及具有规范作用的国际软法等所规定的义务。我国需不断加强立法,遵守国际条约,与其他国家积极进行能源合作。企业要不断提高自身海外能源投资环境保护的标准,以谋求长远发展。

The implementation of the ＂One Belt and One Road＂strategy has created good political and economic conditions for overseas investment of Chinese enterprises. More and more energy-invested enterprises have begun to go overseas. While promoting the host country＇s economic development,these enterprises have caused some damage to the local environment,which is not conducive to the overseas long-term development of China＇s energy investment enterprises. For the current environmental protection of overseas energy investment,China＇s enterprises bear theobligations from the domestic law,the host country＇s environmental protection law and the international soft law with the normative role. The Chinese government must continue to strengthen legislation,comply with international treatiesand improve international energy cooperation with other countries. Enterprises should continue to improve theirenvironmental protection standards for overseas energy investment to seek a longterm development.
