近五十年敦煌契约文书研究综述

Reflections on Dunhuang Contract Documents Research in Recent 50 Years

敦煌契约文书卷帙浩繁,包括借贷、买卖、租佃、放书、分书等,系研究唐五代宋时期的民事契约行为、习惯之第一手重要资料。中外专家学者以历史学、法学等学科的理论与方法,对敦煌契约文书进行了较为深入的考察和研究,已初步显现出契约文书之经济学、历史学、法学等方面的研究价值。笔者从敦煌契约文书的刊布情况、通论性研究以及专题性研究等方面,对近五十年的敦煌契约文书研究成果进行系统梳理,以探求敦煌契约文书近五十年来研究之特点和未来研究之取向。

Numerous Dunhuang contract documents which includes the contracts of borrowing and lending,buying and selling,and renting,and so on,can benefit researchers to obtain the first- hand materials about civil contract behaviors and habits in Dynasty of Tang- Song. Up till now,many Chinese and foreign experts have carried on some deeper researches on Dunhuang contract documents in historical and legal perspectives,which initially manifests the economic,historical and legal research value of contract documents. In this paper,the author,from the publishing distribution,generally researches and specifics subject researches,systematically classifies and studies the research findings of Dunhuang contract documents in recent 5o years,aiming at exploring the features and future tendency of Dunhuang contract documents.
