Analysis on Legal Attribute of Synchronous Audio and Video Recordings

讯问录音录像在讯问的密室中扮演着"第三只眼睛",在一定程度上起到遏制刑讯逼供的作用,但是由于相关法律未将录音录像的证据属性予以明确,导致司法机关在实践中对该资料的处理方式也不统一;许多学者也就录音录像的属性做出分析与讨论,但是学界至今仍然没有形成一致观点。其实判断刑事诉讼中形成的材料是否可以作为证据使用,应当审查该材料是否具有证据的"三性",即客观性、关联性、合法性。因此,在具体案件中,应当采用具体问题具体分析的方法论,准确判断讯问录音录像材料的法律属性。

Synchronous audio and video recording acts as ＂the third eye＂ in the dark interrogation room, which helps prevent extortion of confessions by torture to a certain extent. However, the legal attribute of synchronous audio and video re cordings is not defmed by the law, therefore, the application of it still exists some puzzle. Although many scholars have analyzed and discussed the attribute of the recordings, no agreement was reached. This paper proposes that to judge whether the recordings can be used as evidence in criminal cases, the three attributes of evidence should be examined, namely, objectivity, relativity and legality. So, it＇ s important to confmn the legal attribute of synchronous audio and video recordings in specific cases.
