有毒物质侵权的因果关系分析

The Causation of Toxic Tort

基于当前有毒物质侵权问题颇受关注,分析其因果关系问题是为了确定侵权责任主体以及责任范围。由于有毒物质侵权有其特征性,如隐蔽性、持续性等,这就使该类型诉讼的因果关系分析比一般的传统侵权诉讼更加复杂困难。在有毒物质侵权的认定过程中,需要利用科学理论知识,比如医学上的病理分析知识对事实因果关系进行剖析,因此要辨别因果关系显得尤为困难。我国侵权法立法应当对有关理论及适用科学证据和科学方法的方面有所考虑。

Based on the current toxic tort issues which have been under the spotlight, this paper analyzes its causal relationship to determine tort liability subject and the scope of responsibility. Toxic tort has its own characteristics, such as concealment, sus- tainability, etc., which makes the analysis of its causation more difficult than general tort litigation. In the process of defining toxic substances infringement, scientific theories should be applied, such as knowledge ofhistopathological analysis in medical science. Thus it is difficult to identify the causation of toxic tort. Relevant theories, adoptable scientific evidences and methods should be cousidercd in tort law.
