摘要
我国《政府信息公开条例》实施以来,行政机关较常使用非本机关公开职责权限范围答复申请人,而这其中又以档案部门最为突出。这类非本机关公开职责权限范围答复频率高,既有申请人对政府内部运作不熟悉方面的原因,也有行政机关在答复时不够规范方面的原因。要降低该类答复,就有必要通过修改《政府信息公开条例》第十七条,肯定现有"谁制作,谁公开"的实践,明确"谁制作,谁公开"的规定,并鼓励行政机关在答复非本机关公开职责权限范围时注意各种便民措施的综合运用。
Government agencies,archives agencies in particular,have applied frequently the reason of inappropriate agency to answer the request into replying to requesters since the implementation of Freedom of Information Regulations in China. The reasons behind this frequent application are requesters' being unfamiliar with government operation,and government agencies ' inconsiderate replies. It is necessary for government agencies to adopt various convenient measures in the process of using the ground of inappropriate agency to answer the request. Furthermore, it is needed to amend Article 17 of China's Freedom of Information Regulations in order to establish the principle that the agency generating the information bears the duty of responding to an information request.
