Improving Regional Government Cooperative Agreements for Economic Development——A Case Study of Coastal Area Development in Jiangsu

作为推动区域协调发展的重要手段,区域政府合作协议在消解地区行政壁垒、破除地方保护主义、促进资源等要素自由流动方面发挥了重要作用,日益受到各地方政府的青睐,成为地方政府开展合作所采取的重要方式。考察现有的珠三角、长三角等区域政府合作协议,可以发现虽然协议近年来在数量上快速增长,范围上明显扩大,但是在质量上却存在一些不足:明确的法律效力尚未在合作协议中得到直接体现,公众参与的匮乏导致协议的民主性不足,缺乏系统完备的纠纷解决机制。在推动江苏沿海开发的进程中,沿海南通、盐城与连云港三地政府需要在合作协议中明确协议的法律效力,将公众参与制度纳入三市签署合作协议的进程中,在合作协议中建立完备的纠纷解决机制。

As a means to advance and coordinate regional development,regional government cooperative agreements has won increasing favor of local governments and become a major cooperation mode,because it has played an important role in bringing down regional administrative barriers,overcoming local protectionism and promoting resource flow. It has been observed in the Zhujiang Delta and Changjiang Delta areas that the regional government cooperative agreements have witnessed a growth in number in recent years but the quality is in need of improvement. The problem lies in the implicit expression of legal effect in the agreements,the deficiency of democracy due to little public participation and the lack of feasible dispute solution mechanism. In the development of the coastal area in Jiangsu Province,the governments of the three coastal cities,namely Nantong,Yancheng and Lianyungang,have to clarify the legal effect of their cooperative agreements,establish a public participation system in the process of agreement negotiation,and design a feasible dispute solution mechanism.
