自由贸易区战略是中国国家战略的重要组成部分,从战略观的高度来洞察中国已构建以及将来可能构建的区域贸易协定争端解决机制,对深入理解区域争端解决协定争端解决机制的缘起与未来发展有所助益。在中国现有场域下,区域贸易协定争端解决机制中的战略问题主要表现为权力转移、问题转移和范式转移。具体而言,区域贸易协定争端解决机制的形成既是区域经济组织的权力表征,也是区域贸易争端解决的制度保障,更是区域治理的典型范式。要明晰区域贸易协定争端解决机制的战略定位,应从国内战略、地区战略和全球战略等方面作出战略选择。
