A Tentative Exploration of Translated Legal Terms——A Reflection of Equivalence and Conceptual Transfer

在翻译理论与实践中,等值问题的探讨经久不息。由于语言及文化的差异,法律术语翻译往往会出现概念迁移的问题,表面上与等值形成二律背反。法律术语译名的形成是翻译问题,但又不仅仅是翻译本身的问题。本文基于对法律术语形成及翻译实例的分析,以法律术语翻译的等值建构为视角,重新检视法律术语译名的规范性问题。

Equivalence is a perennial issue in translation studies. However,the inherent differences of languages and cultures inevitably result in the conceptual transfer in the translating of legal terms,which could run counter to the principle of equivalence. Therefore,the adoption of translated terms calls for careful consideration,as it is an issue far beyond translation itself. Based on the analysis of the formation of legal terms and discussion of relevant examples,this paper attempts to explore into the normative aspect of the translated legal terms from the perspective of equivalence theory of translation in a new light.
