摘要
在《侵权责任法》第85条中,所有人以物权变动规则加以确定,管理人强调对物之实体的管理权,使用人重在占有性的使用。使用人是否承担维护义务主要取决于是否存在约定,并与使用人的性质有关。所有人、管理人或使用人并存时,各自承担责任。其他责任人应作目的性限缩,不包括对土地工作物直接施加影响的侵权行为人。
The owner is determined by the rule of changing of real right; the manager emphasizes the management of the entity and the user emphasizes the possession. Weather or not to bear the liability depends on the agreement and the character of the user in the relationship. When there are two types of owners,managers or users,each of them shall take his or her own liabilities. Other responsible person should be restricted that the person trespass to the building is not included.
