“法律解释”与“法律诠释”之术语辨析

Differentiation of “Legal Interpretation”and “Legal Construction”

解释学转向导致了哲学解释学中方法论立场和本体论立场的分歧,解释由人文科学的普遍方法论转化为人的生存方式,自此出现了"解释"与"诠释"的术语界分,导致"法律解释"与"法律诠释"具有旨趣迥异的法理蕴含。对这两个术语进行区分具有法律概念论、政治哲学、道德哲学上的学术意义。

The turnaround of hermeneutics led to a divergence between the position on methodology and the position on ontology in the philosophical hermeneutics. The universal methodology of humanities turned into the human's way of life,since then the terms of'explanation'and'interpretation'appeared,which led to different legal connotations of'legal interpretation'and'legal explanation'. Distinguishing the two terms has academic significance in legal conceptualism,political philosophy,and moral philosophy.
