公告类离婚纠纷案件中的裁判问题

公告类离婚纠纷案件是一类较为特殊的案件,其不仅对于涉及身份关系的案件采用了公告送达方式,而且该类案件较其他公告类案件而言除公告送达风险外,还有一层裁判风险——裁判离婚的不可逆性,因此对于该类案件的裁判应持谨慎的态度。对于不符合离婚条件的,可以直接判决驳回离婚诉讼请求;对于符合离婚条件的,虽可以裁判离婚,但需法官本着对案件负责的精神慎重处理,对于证据严格审查、主动调查,对于离婚涉及的子女抚养、财产分割等问题予以谨慎对待。

The divorced dispute case is a kind of special case. It not only adopts the way of announcement for cases related to identity,but also there is a layer of the risk of irreversible divorce compared with other cases in addition to public notice risk. Therefore, the judgment of such cases should be cautious. If the divorce does not meet the conditions, the request of divorce proceedings can be direcdy rejected. If the divorce case meets the conditions of divorce, although the divorce can be judged, the judge of the case should handle it carefully with the spirit of being responsible, including strict examination, active investigation, and the problems of divorce involving child custody and division of property which should be treated with caution and justice.
