我国建构食品安全事故补偿基金的若干问题探析

Research on the Construction of the Food Accident Compensation Fund in China

食品安全事故补偿基金是一种公益性基金,当食品安全事故中的受害人,无法通过其他途径获得赔偿时,基金将对其提供及时、有效的救济。文章首先介绍了食品安全事故补偿基金的特征和价值功能。其次,对补偿基金的两种模式进行比较分析。最后,对我国补偿基金的资金来源、管理机构以及法律运行问题进行了深入的研究。

Food accident compensation fund is a public welfare fund, which will provide timely and effective relief for the victims when they can not obtain compensation by other means. At first, this paper introduces the characteristics and the value functions of the food accident compensation fund. Secondly, it analyzes the two modes of compensation fund comparatively. At last, it makes a further research on the funding sources, management institutions and legal operation problems of the food accident compensation fund.
