互联网时代下网络作为重要媒介在服务业信息沟通中占据重要地位,互联网平台公司、服务提供者及消费者之间的劳动关系也成为值得深思的议题。目前对互联网平台公司与服务提供者之间有劳动关系说、劳务关系说、合作关系说等不同观点,对此应根据互联网平台公司提供服务的特点对原有劳动关系"三要素"予以适当的扩大解释,将部分基于互联网平台公司提供的劳动服务纳入劳动法保障范畴以保护各方利益。

Internet network, as an important intermediary , has obtained an irreplaceable place in the communication and information services industry . The relationships among the Internet companies, the service providers and consumers has been a hot topic to be discussed. There are three different opinions about the relations between the company and Internet service provider and the Internet platform company need to be studied . Some relationship of the labor - based internet platform and services company should be put into the scope of labor law to protect the interests of all parties.
