摘要
城市治理过程中,公众通过参与政府特许经营PPP项目的决策和执行表达意见并对政府的最终决定产生影响。然而,在政府决策或执行过程中,公众参与不足、参与效力低等问题常常使得公众参与流于形式。这些问题的解决,需要界定参与过程中一般社会公众、专家、利害关系人等不同主体之间的关系,明确不同类型PPP项目参与方式的适用和参与效力的等级划分标准,以及建立参与效力保障和责任追究机制,给公众参与以法律强制保障。
During the course of city governance, the public get actively involved by expressing their opinions over the decision - making and implementation of the government franchise PPP projects and further imposing due influence on the government' s final decisions. However, such issues as insufficient participation and low effectiveness over the session of decision - making and execution have all too often rendered public participation nothing more than a formality. And the answers to these issues lie in clearly defining the relationship among the general public, experts and interested parties during the course, explicitly specifying the division standard for the applicability of participation form and the rating of participation effectiveness and tully establishing safeguard mechanism and responsibility investigating system,lending law enforcement guarantee to participation effectiveness.
