依法治校背景下高校处罚违规学生的问题及对策

Problems and Countermeasures of College Students Punished because of Getting Out of Line under the Rule of Law

在依法治校的背景下,学校应依据国家的有关法律规定制订管理制度,依据规章制度处罚违规学生,维护学生的合法权益。目前,我国涉及违规学生处罚的法律制度还不完善,学校处罚违规学生的程序和标准不规范,学校对处罚违规学生的认识不足,导致学校处罚违规学生的随意性比较大,侵犯了违规学生的权利。高校应提高对违规学生处罚的认识,加强制度建设,营造良好的法治环境,把法治和德治有机地结合起来,依法处罚违规学生,保护学生的合法权利。

Under the rule of law, in order to safeguard the legitimate rights and interests of students,management rules of schools should be formulated and the illegal students should be punished according to the relevant laws and regulations of the country. At present, neither the student illegal punishment system nor the norms and standards are not perfect in China. The rights of students are violated. Colleges should enhance their awareness, strengthen the system construction, create a good environment for the rule of law,and combine the rule of law and morality organically.
