人民法院审判事务职责分工模式实证研究

当前法院审判资源的配置，以及“法官＋书记员”工作模式存在诸多弊端。对“法官＋书记员”工作模式分工状况进行分析．认为构筑“法官＋法官助理＋书记员”的新型工作模式是当前问题的解决之道。通过对审判事务与审判辅助事务进行合理区分，进一步明确法官与审判辅助岗位的职责权限。明确审判辅助人员的性质和定位，厘清法官与审判辅助人员的关系，增设法官助理，重新调整法官与审判辅助人员的职责分工。提出新型审判模式下法官与审判辅助人员职责的合理分工，希望对司法改革有所助益。

There are many drawbacks in the allocation of court trial resources and the working mode of ＂judge ＋ clerk＂. The author analyzes the division of the work pattern of ＂judge ＋ clerk＂, and thinks that it is the solution of the current problem to construct the new mode of ＂judge ＋ assistant judge ＋ clerk＂. Through the trial affairs and adjudication of a reasonable distinction between the trial to further clarify the role of judges and adjutant positions of competence. Clarify the nature and position of adjudicators, clarify the relationship between judges and adjudicators, set up assistant judges, and re-adjust the division of duties between judges and adjudicators. The new mode of trial under the judge and adjudicators of the duties of a reasonable division of labor, hoping to help the judicial reform.
