论我国转售价格维持的规制路径

Statement in Regulation Path for Resale Price Maintenance of China

转售价格维持是近年来反垄断经济学及反垄断法中最具争议的核心问题,至今在反垄断执法中仍没有形成明确、统一的分析方法和结论。我国很多行业中普遍存在转售价格维持行为,但由于我国反垄断立法的缺陷及执法、司法经验的不足,造成对案件的不同处理方式和结果,极大地损害了我国《反垄断法》的可预见性和稳定性。在反垄断经济学分析的基础上,结合欧美发达国家或地区的立法和实践经验,提出可行的反垄断分析规则和执法政策,为我国的反垄断立法、执法及司法提供理论支持。

Resale price maintenance was the most controversial issues in antitrust economy and antitrust law, and it had not form clear and uniform analysis approach and conclusion in antitrust law enforcement. In China＇s industries, the resale price maintenance behavior existed commonly, but the treatment mode and result were different because of the defect of legis- lation of China＇s antitrust law and the shortage in enforcement and justice, which had severely damaged the predictability and stability of China＇s Antitrust Law. Based on the analysis of antitrust economy, by combining the legislation and practice expe- rience from developed nations and regions, this article puts forward feasible analysis rules and enforcement policy of antitrust, which provides theoretical support for China＇s antitrust legislation, enforcement and justice.
