我国家庭农场的商主体地位研究

The Principle Status of Business of the Family Farm in China

作为新型农业经营主体的家庭农场,在中央一号文件精神的指引下快速兴起。现阶段,由于家庭农场仍未被赋予法律主体的地位,导致规划不合理、资金来源单一以及政策支持力度不够等问题。家庭农场作为商主体的法律地位符合法律规定和现实需求,为进一步规范家庭农场以保证其发展,确立家庭农场的商主体法律地位已势在必行。

The family farm, as new type of agricultural business body, develops very fast with policy support of the central government. At current stage, family farms are not en- dowed with the status of legal subject. This leads to the problems such as irrational plan- ning,mono capital source and powerless policy support. Family farms, as business subject, are in conformity with laws and practice. It is necessary to set up their legal status as business subject to insure its development.
