从食品安全谈我国转基因食品的专利风险及对策

On the patent risk and countermeasures of genetically modified food in China from the perspective of safety

转基因食品作为新型高科技的产物,从出现到现在仅二十余年,由于并未经过长期的安全性试验,必然存在许多不确定因素与争议。目前我国对转基因食品无论是从立法、研究现状还是从食品安全的审查、专利的认定及法律的审核方面都存在许多缺陷,所以有必要对转基因食品形成统一且实时更新的检测标准,建立完善的追踪机制,同时构建多重保护模式强化对转基因食品的管理。这样才能有效地降低由于专利风险带来的食品安全问题,并在转基因食品进入市场后对其进行实时监控。

As a new hi-tech product, genetically modified food （GMF） has been emerged only for twenty years. Lots of uncertainties and controversies exist for lacking of the result of a long-term safety assessment. There are flaws in respect of research status and examination of food safety, patent affirmation, and legal review. Thus, it is necessary to build up unified and time updated standard detection methods, tracking mechanisms, and multiple modes to protect GMF from patent risks after they enter markets.
