经济活动的法治环境是指在生产、分配、交换、消费的过程中,法律赋予管理者管理经济活动的权力与经济活动主体参与经济活动的权利及其运行所形成的一种氛围。经济活动的法治环境属于社会文化环境,是与经济活动相关的法律氛围,属于社会人文环境,具有区域性特点。它以系统的经济方面的立法为基础,加之公平的经济行政执法,公正的经济司法以及经济活动主体对法遵守等要素构成。其类型可以从不同的角度进行划分,根据经济活动的产业特征可以划分为单一产业型法治环境和综合产业型法治环境;根据经济活动法治环境形成的动因划分为国家主导型法治环境和市场需求型法治环境。经济活动法治环境具有对经济活动的规制作用、保障作用和塑造作用。
