The progress of the society is closely related to the development of the network, it brings convenience to people＇ s life, at the same time, network infringement is also growing because of a variety of incentives. In our country, it is very difficult to safeguard the rights of network due to the serious lag of China＇ s network legislation, as well as network infringement has the characteristics of strong damage, the difficulty of investigating and obtai- ning evidence, the main body of tort liability and the uncertainty of territorial jurisdiction. We should distinguish between the network infringement and the traditional infringement from the perspective of legislation, the causes of network infringement are deeply discussed based on the characteristics and the target of network infringement. We should adopt measurements to safeguard the legitimate rights and interests of the majority of internet users through the relevant legislation to establish and improve the network tort responsibility, improve government supervision function, strengthen the network user＇s infringement awareness, define liability for network and regional management content refinement way.
