司法现代化视角下的我国民事电子送达问题研究

Study on the Civil Electronic Service of Our Country in the View of Judicial Modernization

2015年立案登记制度的确立促使大量案件涌入法院从而加大了法院送达工作量。面对高人口流动量及案件压力,法院通过采用高效、便利的现代化电子送达方式来缓解送达工作压力。虽然2012年新修改的《民事诉讼法》对电子送达的适用赋予了立法依据,但是电子送达立法规定单一,导致电子送达使用率低下、法院确认收悉困难、送达文书的信息安全受威胁的问题阻碍了其顺利推行。在司法改革及司法现代化备受关注之际,在借鉴国外先进立法经验及国内一些法院的实践做法,分析一些学者在推行电子送达上所提出的新观点的基础上,提出通过完善立法规定来解决上述问题并达到充分利用科学技术高效、便利等优势的建议有其重要的理论及实践意义。

The establishment of the registration system in 2015 prompted a large number of cases into the court, which has increased service workload of the court. Facing with the high population flow and case pressure, the court has used efficient and convenient modern electronic service to relieve the work pressure.Although the amend of civil procedure law in 2012 gives the legislative basis for the electronic service,electronic service legislation is simple, which leads to low utilization rate of electronic service, and the court hard to confirm the receipt, and threats legal documents information security, which has been hindered its smooth implementation. While the judicial reform and the judicial modernization has received much attention, in reference to foreign advanced legislative experience and practice of some domestic courts, analyze some scholars new point of view in the implementation of electronic service, put forward to improve electronic service legislation to solve the above problems and make full use of the efficient, convenient advantages of science and technology has important theoretical and practical significance.
