市政工程施工致商户经营性损失补偿机制探析

On the Compensation Mechanism to Merchants' Operating Loss Caused by Municipal Engineering

市政工程施工容易造成周边商户营业收入下滑,对特定群体造成超出社会平均负担水平的利益损害,国内尚欠缺相关补偿机制。出于社会成本内部化以及维护社会公平的需要,地方政府应建立相关补偿机制,以发放补偿金或减免税等形式对商户损失作出适当补偿,并加强工程管理与信息公示。国家应加强行政补偿法制建设,将公权力行为随附效果导致的损失纳入补偿范围。

I It＇s common for the municipal engineering construction to cause losses to the local merchants, and yet the compensation mechanism is still lacking in China. For the needs of social cost internalization and social equality, the local government should establish the benefit compensation mechanism to compensate for the losses of merchants in the form of payment and tax relief, while strengthening the project management and information disclosure. Our country, moreover, should promote the legal construction of administrative compensation, and take into account the losses caused by public power＇s accompanied effects.
