法治中国建设的“共建共享”路径与策略

The Path and Strategy of "Joint Construction and Sharing" of the Construction of China Ruled by Law

纵观30多年来中国的建设发展进程,呈现着从"国家构建"走向"共建共享"的变革轨迹,因此,当下的法治中国建设就应采取共建共享的建设路径。这既是化解转型风险的迫切需要、社会主义国家性质的客观要求、传统文化与本土国情的最优选择,也是共享经济时代的必然反映和世界变革趋势的重要体现。而基于这一路径,则需要通过国家与社会层面的共建共享、中央与地方层面的共建共享、多元社会层面的共建共享的推进策略,来塑造双向构建、多元包容、共建共享的法治秩序,进而实现法治中国建设的战略目标。

Construction of China and its development during the past 30 years can be characterized by the trace from ＂ nation-state construction＂ to ＂joint construction and sharing＂, therefore, the current construction of legal China shall adopt the path of joint construction and sharing. This is not only the urgent need to release crisis in society change, the objective requirement from fundamental personality of socialism nation and the best choice for traditional culture and indigenous national situation, but also the essential reflection of shared economy age and significant indication of the worldwide revolution tendency. The strategy system should be established by the ＂ joint construction and sharing＂ of ＂nation-society＂, ＂ center-locality＂ and ＂ plural society＂, so that the legal order with characters of bidirectional construction, multiple inclusion and harmonious co-evolution can be formed and the strategic target of ＂Rule China by Law＂ can be achieved.
