明确养老志愿服务当事人的范围及其法律关系,确定养老机构等作为当事人的特别权利和义务,从鼓励公众参与、强化志愿者谨慎服务出发,豁免志愿者一般过失的侵权责任,确定养老志愿服务组织的无过错责任。鼓励建立志愿服务协议制度,优先推行养老志愿服务保险,促进养老志愿服务健康发展。

This paper clarifies the scope and legal relationship of the parties. Determine the special rights and obligations of the elderly service institutions.Encourage the public participation, strengthens the volunteers＇ prudent service, and exempt the volunteers from the general negligence tort liability. Determine the old-age volunteer service organization without fault liability. Encourage the establishment of voluntary service agreement system, give priority to the implementation of old-age volunteer service insurance and promote tlie healthy development of old-age volunteer service.
