“Constitution Embodying Prosperity”——the Alternative Interpretation on Chinese Constitutional Spirit

在西方国家,宪政自身的价值和精神就是通过防御性的制度设计控制国家权力,为个人权利和自由的行使提供空间,而近代中国人对宪政的探索是站在靠宪政谋求国家富强的价值选择上考虑的。尽管我们当今的立宪活动不断将图国家富强与实现民主、人权的时代需要相结合,但"富强宪章"的价值内涵一直伴随着中国历来的立宪与行宪实践,这为我们从不同于民主与人权的角度去解读宪法精神提供了新视角。

In Western countries, the value and spirit of constitutional politics is, through defensive design of system, to control state power, so as to provide enough space for people to enjoy individual rights and freedom. The explorations on constitutional politics made by modern Chinese are based on the value choice for realizing national prosperity through constitutional politics. Although we, through current constitutional activities, combine national prosperity with the demand of realizing democracy and people＇s rights, the value connotation of ＂constitution embodying prosperity＂ has been being stressed in constitution and practice in history, which provides us with a new view, which is different from the view of democracy and people＇ s rights, to understand constitutional spirit.
