地权纠纷中的集体成员权表达

Expression of Collective Member Rights in Land Property Rights Disputes

一般认为,在地权纠纷中,"户籍"是集体成员权身份和资格认定的唯一核心要素。然而,事实并非如此。通过对东北林权改革中,村级合并、户籍回迁和"外嫁女"土地权益三类案例的考察,发现地权的内涵与其说是集体成员权的展现,还不如说是村落成员权的表达。实践中的集体成员权表达了村民对社区财产边界、共同体成员和伦理身份的认同,实际上展现的是一种村落成员权。基于血缘和地缘,村落成员权具有排他性、独占性、人格化和继替性特征。它具体呈现了社区内部共享的文化价值、社群网络、互助体系和互惠模式,具有内在的封闭性和保护性,是村落共同体存在的一种表现。

It is generally believed that in land ownership disputes,＂hukou＂is the core elements of collective member rights identity and qualification. However,this is not the case. In the northeast forest right reform,based on the investigation into three cases of disputes on village-level merger,＂hukou＂register disputes between outsiders and locals and land rights of ＂Wai Jia＂women,the research found that the connotation of land rights is an expression of village members＇ rights,rather than collective member rights expression. Practice of collective member rights expresses the villagers of community property boundary,members of the community and ethical identity; actually it shows the village members＇ rights.Based on consanguinity and geography,the village members＇ rights have exclusiveness,personification and continuity that present the shared cultural values,community network,the mutual aid system and reciprocal mode within the community,has intrinsic closeness and protective,is an existing form of village community.
