摘要
由于岛内有关政党、机构和阶层的认知差异,两岸协议从诞生之日起便面临着是否需要以及应当如何接受台湾"立法"机构审议监督的巨大争议。出于政党斗争的需要,民进党以"立法"机构为平台,以不确定性法律概念的泛化解释为突破口,滥用党团协商制度,强势操弄议事规则,使得两岸协议的审议超越了既定法律框架,呈现出泛政治化的状态。这种紧张关系短期内无法迅速消解,只能随着岛内统"独"斗争的趋缓与两岸政治互信的增强而逐步缓和。
Due to the different understandings of political parties, institutions and social classes, there has been huge controversies on the legislative supervision of Cross-Strait agreements ever since the very beginning of Cross-Strait consultations. In the course of party politics, the supervision of Cross-Strait agreements in the legislative body has gone far beyond the exiting legal framework as a result of the extensive interpretations of uncertain legal concepts, abuse of caucus negotiation and manipulation of procedural rules. Such pan- politicalization phenomenon can never be undone in the short term, but will ease with the fall of the unitive- separatist struggle in the Taiwan Region as well as the enhancement of political mutual trust of the two sides across the Strait.
