Research on Compensation Mechanism in Legal Deposit System of Publications

出版物法定呈缴是保存文化遗产、保障信息资源自由利用的手段。文章对补偿机制的概念逻辑与主客体进行研究回顾;以58个国家和地区为对象,调查呈缴制度及其补偿机制的实践情况,分析各个国家和地区呈缴制度立法形式,归纳总结不同补偿方式及其代表性国家和地区,讨论补偿机制的实施效果;对电子、数字和网络出版物的呈缴制度及补偿机制的新动态进行跟踪调查,分析呈缴制度在立法形式、呈缴对象、呈缴方式上的特点与变化及补偿方式的多样化特点,在此基础上思考各个国家和地区制定或完善呈缴制度立法的可能方向,探讨补偿机制实施的可能性及必要条件。

Legal deposit system of publications is of significance in preserving cultural heritage and free information use. This paper first gives a brief introduction to the legal deposit system and makes a review of the concept and related subjects about its compensation mechanism. Then, it does a research on the practices and the compensation mechanisms of legal deposit in 58 countries and regions, analyzes their legislation formats, summarizes the compensation methods and the representative nations, discusses the effectiveness of those compensation mechanisms, and does a follow-up study of electronic, digital and network publications for legal deposit and compensation mechanism. Finally, it analyzes the features and trends of legal deposit in legislation formats, publications covered, submitting ways, and the diversity of compensation mechanism. Based on the above, the author discusses the possible changes of making or amending legal deposit legislation, and explores the possibilities and necessary conditions of carrying out compensation mechanism in different countries.
