摘要
伴随着我国经济结构调整和创新驱动发展进入新常态,劳动者的利益需求越来越呈现的多元化特征。集体劳动争议也呈现出了数量增长快、规模扩大化、多样化形式、利益诉求多元化、爆发集中化、组织性更强等新特点。研究当前集体劳动争议的发展特点及应对措施,重点考虑畅通劳动者的诉求渠道,积极调整工会与仲裁、审判机构的功能,更好发挥它们的作用,让集体劳动争议在和谐的社会环境中实现良好协商、高效调解、公平仲裁、公开审判。
With the adjustment of economic structure and the development of innovation into the "new normal" situation, the interest claims of workers are becoming more and more diversified. Collective labor disputes also show features with rapid growth, expanded scale, diversified forms, diversity of interests, the outbreak of the centralized and organized. This paper focused on the developing characteristics of collective labor disputes and responses. In order to make the collective labor disputes to be resolved in the harmonious social environment with good coordination, efficient mediation, fair arbitration and public trial, the government should consider to keep the channel for labors interests claim always open and actively adjust the unions , the function of arbitration and judicial organizations so that they can play their appropriate roles during the process.
