环境法与环境伦理的关系:美国环境法学界研究的状况

Relation between Environmental Law and Environmental Ethic:Status of Research in the Environmental Law Academia of the United States

自环境法诞生四十多年来,环境伦理给环境法多大的支撑、应该发挥多大的作用、如何更好地发挥作用等理论与经验问题在美国环境法学界一直是一个热门话题。而梳理这些讨论,也有助于我国环境法学界思考环境法与环境伦理的关系问题,并进行沟通与对话,进而建立制度和措施来促成研究的实践效应。

Since the introduction of the Environmental Law over 40 years ago,many theoretical and experience issues have been heatedly discussed in the environmental law academia of the United States,such as how much does environmental ethic support environmental law,what role should it play,how to better make use of it. Review on these discussion would facilitate the consideration of the relation between environmental ethic support environmental law for China＇s environmental law academia,and prompt communication to establish institutions or take measures to promote the application of research.
