摘要
随着经济全球化不断深入,我国提出打造"21世纪海上丝绸之路"的战略构想,旨在增加与沿线国家的利益交汇点,与相关国家共同打造政治互信、经济合作、文化交流、同呼吸共命运的区域共同体。中国海事局作为重要的海上执法机构,在海上行政执法过程中除了要行使既有法定职权,更需要拥有海事事权,使得法定职权得到有效行使,切实在保护海上航道安全、推动各国海上经贸合作、保护海洋环境等方面发挥重要作用。因海事事权较为特殊,在执法操作层面较为复杂,因此,在宏观层面就确立海事事权的原则进行讨论显得尤为必要。
As economic globalization is in further progress, China came up with the strategic conception of "21st centurymaritime silk road" in order to increase common interest with the countries along the road, co-construct a regional communitywith relevant countries on politically mutual trust, economic cooperation, cultural communication and shared fate. China Bureauof Maritime Affair as a leading law-enforcement organ on sea shall exercise given legitimate authority in exercising executivelaw enforcement and all the more need to own maritime-affair power to enable legitimate authority to be practiced effectivelyto secure seaway safety, promote trade and economic cooperation on sea between one country and another and protect oceanenvironment. As maritime-affair power is special, it is more complex in law-enforcement, it seems to particularly necessary todiscuss about the principle of establishing maritime-affair power.
