国际工程承包保函欺诈的时效及功效控制

The aging and efficiency control to the guarantee fraud in the international engineering contracting

当前国际工程承包中应对保函欺诈措施的实际操作性不强,存在保函被业主恶意索赔的风险。从时效及功效控制两方面提出防范措施,以期达到对保函项下的欺诈行为进行防控,保障承包商利益的目的。

In view of the poor operability of the current coping measures to the guarantee fraud in the process of international engineering contracting, and confronting with the malicious claim risks of the guarantee from the beneficiaries, the paper proposes the preventive measures from two facets including aging and efficiency control, in order to achieve the purpose of precautious control to guarantee fraud and to guarantee the contractor＇s interests.
