同人小说构成“转换性”合理使用的理解与适用——基于金庸诉江南《此间的少年》著作权侵权案的评论

The Understanding and Application of Constitutive Requirements of Transformative Fair Use in Fan Fiction——Comments Based on "The Juvenile Here" Copyright Infringement Dispute Between Jin Yong and Jiang Nan

同人小说是一种利用现有作品特定元素进行二次创作的文学创作形式。由于同人作品对原作品存在较强的依附性,且越来越多同人作品投入商业运作,同人小说是否构成著作权侵权的问题,引起较大争议。笔者认为,从鼓励创作、促进文化和科学事业的发展与繁荣的立法目的出发,符合一定构成要件的同人小说构成对原作品的合理使用,不构成著作权侵权,《此间的少年》案即属于此种情形。基于此,笔者在下文中浅析同人小说构成"转换性"合理使用的理解与适用。

Fan fiction is a kind of literary forms of secondary creation by using specific elements of existing works. A growing number of people work into the commercial operation of fan fiction, the question of whether fan fiction constitutes copyright infringement is becoming controversial due to the strong dependence of fan fiction on original works. For the legislative purpose of encouraging literary creation and promoting the development and prosperity of culture and science, the author reckons, as happened in the case of ＂The Juvenile Here＂, it constitutes a fair use of the original work rather than a copyright infringement if the fan fiction meet certain constitutive requirements. In the thesis, the author will analyse how the＂fan fiction＂ constitutes ＂transformational＂ fair use based on the above views.
