摘要
形式化的演绎逻辑分析表明,劳务派遣制度具有经济合理性,不过这种经济合理性的发挥需要有三个前提条件,即政府管制、市场竞争和社会调节,而目前劳务派遣领域的种种乱象,主要归因于这三个条件未能在各自的限度内发挥好各自的作用,具体表现为政府管制过度、市场竞争不充分和社会调节欠缺。
The formality of inductive analysis indicates that the labour dispatch is economically reasonable. However, there are three prerequisites for the reasonableness, namely, government control, and social mediation. By far, the chaotic situation of labour dispatch is mainly attributive to three preconditions which could not take appropriate effect in practice. The over-control of the government, insufficient competition in the market and scarcity of social mediation are the issues.
