熟人社会背景下的农村法治文化建设

The Construction of Legal Culture in Rural Areas under the Social Background of Acquaintances

法治文化是法治建设的重要支撑,但在中国特殊的历史文化传统下形成的熟人社会缺乏法治文化的土壤,加之新中国成立后的政治运动冲击与当下官本位思想的影响,导致农村法治文化建设困难重重。为了有效推进农村法治建设,对于农民方面,必须针对农村不同群体采取形式多样内容丰富的法治教育,培养树立农民的法律理念;对于权利保护和权力制约方面,要不断完善法律制度,保障不同主体的法律实践活动,通过规范政府权力的运行,维护农民合法权利;同时,还要发挥社会组织的优势力量去解决农村经济、文化和生态环境等现实问题;只有通过全面调动各方面的力量才能更好地推动农村文化的形成和发展,实现法治农村的目标。

Culture of governing by law is an important support for the construction of the rule of law, but the acquaintance society formed under China＇s special historical and cultural traditions is lack of soil for it. To make matters worse, the political movements after the founding of New China and the current bureaucracy make the construction of culture of governing by law in rural areas very difficult. In order to promote it, we should help the farmers cultivate their legal concept; improve the legal system to guarantee different subjects＇ legal practice; maintain the legitimate rights of farmers; at the same time, we should give full play the advantages of social organization to solve the problem of rural economy, culture and ecological environment etc. Only by fully mobilizing various aspects, can we promote the formation and development of rural culture, and achieve the goal of governing by law in rural areas.
