电子政务下我国政府信息公开立法问题研究

On the Legislation of Government Information Disclosure in China in the Context of E-government

政府信息公开并不是在互联网时代才出现的对政府的新要求,但以互联网为代表的信息技术无疑为推动政府信息公开提供了新的机遇和便利。在电子政务快速发展的背景下,政府信息公开也具有与以往不同的新特征和新问题。本文特别关注以互联网为代表的信息技术对政府信息公开立法与实践的影响,通过梳理我国近年来信息公开立法的发展情况,分析我国信息公开立法的推动因素及实践中遭遇的瓶颈,并对电子政务时代政府信息公开的若干问题进行探讨。

The call for the government to make government information open to the public is not new till this Internet age,but the information technology represented by the Internet does facilitate and offer the opportunity for it. In the context of rapid development of e- government,the government information disclosure has presented new features and new problems as well. This paper highlights the effects of Internet- based information technology on the legislation and practice of government information disclosure,reviews the development of its legislation in recent years,and analyzes the motivating factors for its legislation and the bottlenecks in its implementation,and discusses some issues concerning the information disclosure in the era of e- government.
