基于30宗报道案例为视角对警察出庭作证实践状态的思考

Thinking of the Practice State of the Policeman's Appearing in Court as A Witness Based on the Perspective of 30 Cases Reported

警察出庭作证是在全面推进依法治国方略背景下的一项重大司法改革措施。警察出庭作证将成为公安机关常态工作之一,对于推进以审判为中心的诉讼制度改革具有重要的作用和意义。作者以公开报道的30宗警察出庭作证案例为研究对象,对警察出庭作证的地域分布、案件性质、争议内容、作证内容、相关措施等实践状态进行了分析,认为当前警察出庭作证流程已初步形成,但出庭作证仍以临时培训为主,且偏重于技巧训练。故而,作者提出应加强"以审判为中心"的诉讼理念,开展警察出庭作证的能力培训,以及完善警察出庭作证的相关法律制度。

Police appearing in court as a witness is a major judicial reform measures in the context of the overall promotion of the rule of law. It is important role and significance to push forward the litigation system reform of trial center.We researched 30 cases of police witness which have reported in internet, we have finished the analysis of the practice state of regional distribution, the nature of the case,the content of the dispute, the content of appearing in court, and the relevant measures. For this reason, we draw a conclusion that the process of the police witness system has been built, and the training of policeman need to be reinforced. Therefore, we think that we should upgrade the concept of trial center, enhance the education of police officer, and improve the legal system of the police witness.
