论舞蹈作品知识产权的保护策略

On the Protection of Intellectual Property Rights of Dance Works

本文从知识产权的法律概念切入,对舞蹈作品的保护维度、舞蹈作品的知识产权结构,以及舞蹈作品知识产权保护的具体内容进行了全面分析。本文作者以亲身经历的琼瑶诉于正《宫锁连城》(电视连续剧)著作权侵权案为例,给舞蹈作品的侵权判定提供了宝贵的借鉴。与此同时,本文还从知识产权保护的操作层面入手,介绍了舞蹈作品版权登记方式,并以中央芭蕾舞团与梁信关于《红色娘子军》的著作权纠纷为例,分析了合同签署的重要性与合同签署时需要关注的问题。本文最后还给舞蹈行业提出了几点相关建议。

This paper starts from the legal concept of intellectual property rights, and explores the protection dimension of intellectual property rights of dance works, the structure of dance works＇ IP, and the specific content of the protection of intellectual property rights of dance works. According to the copyright infringement case of Qiong Yao＇ s suing Yu Zheng＇ s Palace3 ： The Lost Daughter （TV Series） , the lawyer who is the author of this paper provides some valuable references to the dance works infringement. At the same time, this paper also introduces the dance works copyright registration from intellectual property protection operation aspects and takes the ballet Red Detachment of Women＇ s copyright dispute as an example to analyze the importance of the contract problems. Finally, this paper puts forward some suggestions to the dance profession.
