摘要
河南省作为第三批司法改革试点地区,相关的改革工作正在部署中。河南省法官检察官职业准入和选任制度与全国一样,存在双考中"劣币"驱逐"良币"、扎堆报考、年龄限制不合理、选任方式行政化等问题。建议在改革中要吸收国外先进制度和改革先行试点地区的成功经验,特别注重制度理念现代化、司法队伍精英化、任职回避严格化、选任机构专门化、任前公示实效化和职业流动常态化等方面的制度建构。
As the third batch of judicial reform pilot areas,the relevant reform work is being deployed in Henan province. Like the whole country,judge and prosecutors professional access and selected system in Henan province have many problems,for example,the "bad money"instead of the "good money"in the two examination,too many people gathered in an examination,unreasonable age limit,selected way administration,etc. This paper suggest to absorb foreign advanced system in the process of reform and the successful experience of the first pilot areas,especially focus on the modern system of thought,judicial elite team,strict avoiding system,selected institutions specialized standardization,the public show before enter the position,professional flow normalization,and other system construction.
