摘要
高校毕业生在就业过程中经常遭遇合法权益被侵犯的情形,主要原因是其劳动者身份还未被法律承认、各级教育主管部门和高校未对此加以重视以及我国相关法律法规设计的事前预防与事后救济措施存在缺陷和漏洞等。为保障高校毕业生在就业过程中的合法权益,需要从将"三方协议"纳入《劳动法》的调整范围、构建较为完善的就业法律课程体系和强化对高校毕业生就业权益侵害的救济等方面着手解决。
College graduates often encounter the phenomenon of legitimate fights and interests have been violated in the employment process, the main reason is that the identity of workers has not been recognized by law, all levels of education departments and universities paid no attention to this phenomenon, and the prevention of China's relevant laws, regulations and post relief measures have flaws and vulnerabilities. In order to guarantee legitimate rights and interests of the college graduates in the employment process, China needs to take measures from including the "three party agreement" into the scope of Labor Law, establish a more perfect legal system and strengthen the measures of infringe the employment fights of graduate students, in order to solve the problem.
