摘要
作为政府生态责任追究主体,目前我国社会公众在实践中基本上扮演的是缺位者角色,其缘由主要是社会公众相关的意识不强、能力不足和相关的制度供给不足与制度局限。在国家有关法律政策和学者建言献策中,社会公众基本上属于不平等关系中的参与者角色,这必然会存在参与目标上的非实质生态民主性、参与动机或目标上的私益性、参与主体选择的狭窄性、参与范围的有限性和参与结果的被操作性等诸多局限。在未来发展趋势中,还需要积极呼唤与倡导属于真正平等治理结构中的合作者角色,但这需要社会公众首先成为社会自治者,需要一种新型的合作精神、合作制度和一定的合作技术。
As the main role in pursuing ecological accountability of government,the public in China basically acts as the absentee in practice now,which mainly stem from the weak awareness and the deficient ability of the public,and supply scarcity and the limitation of the relevant system.Be generally classified as the attendance of unequal relationships in relevant national legislations and policies and in advices and suggestions of scholars,which certainly appears insubstantial ecological democracy of the participant motivation,the private benefit of the participant motivation or goal,straitness of the participant' s choice,boundedness of the participant range,controllability of the participant result and many other limitations.It will be positively demanded and advocated to the role of the cooperator of the true equal governance structure in the future development trends,but it needs the public to be the social autonomies at first,while also requires a new team spirit and a collaboration system,and some cooperation technologies.
