环保行政约谈制度的现实困境与完善路径——基于功能主义立场和行政过程视角的审思

Environmental Protection Administrative Interview System:Realistic Plight and Improvement Path——Reflections based on Functionalism and Administrative Process

环保行政约谈作为现代行政活动展开的一种方式,突破了传统行政行为理论,属于非正式行政活动,环保行政约谈制度有补充、保障、促进和预防功能。然而,目前环保行政约谈制度的设计仍无法摆脱传统管制思路,制度运行存在着公众参与不足、协商合作要素缺失、依赖末端治理等问题。从行政过程的角度审思,环保行政约谈呈现复杂的动态过程性,需要在主体要素上实现广泛的参与行政,在手段要素上重视激励型环境行政指导、环境行政契约和环境行政调解的导入,在程序要素上对环保行政约谈进行规制。

As a way of modern administrative activities, environmental protection administrative interviews break through the traditional theories of administrative action, belonging to informal administrative activi- ties. Environmental protection administrative interview system performs the functions of supplement, protection, promotion, and prevention. However, the design of current environmental protection adminis- trative interview system is still influenced by the traditional control method, whose operation is flawed by insufficient public participation, absent consultation and cooperation elements, dependent on end treatment of the problems. Examined from the perspective of administrative process, environmental protection ad- ministrative interviews are a complex dynamic process. They appeal to the wide administrative participa- tion of the main body and encourage the introduction of such means as environmental administrative guid- ance, environmental administrative contract, and environmental administrative mediation. The procedure of environmental protection administrative interviews should be regulated.
