剥夺政治权利刑的立法问题研究

剥夺政治权利刑(以下简称"剥权刑")是资格刑的重要内容之一,是刑罚体系中的重要一环。伴随国际社会刑罚的轻缓化趋势,相对于主刑较轻的附加刑的地位将会得到更多的重视。但在剥权刑被得到重用之前,我们看到,它还存在一些问题:剥权刑的内容过于狭窄、适用范围不科学、缺少对未成年人特别适用的规定。试从剥权刑的内容、适用范围存在的问题分析,提出修改剥权刑的几点建议,以期更好地发挥其价值。

Deprivation of political rights punishment （ hereinafter referred to as ＂the fight of punishment＂ ） is an important con- tent of qualification penalty and an important part of the penalty system. Along with the international mitigation of punishment trend, the supplementary punishments would receive more attention. But there are some problems concerning the punishment of striping rights is adopted . So , the contents of punishment of striping fight , the application scope are discussed in this paper and we proposed some modification should be made in order to better play the value of punishment of striping right.
