论行政行为概念的界定——以新《行政诉讼法》受案范围的变化为视角

On the Definition of Administrative Act——From the Perspective of the New Administrative Procedure Law

新修订的《行政诉讼法》将"具体行政行为"改为"行政行为",取代了具体行政行为与抽象行政行为二维体系的行政行为分类。"行政行为"已由学理概念正式成为法律概念,但是,行政行为入法带来了行政诉讼受案范围的增加,司法审查模式的变化。因此,有必要梳理域外域内对行政行为的概念的有关学说,重组界定行政行为的概念,以推动我国行政法学理论的深入研究,并为司法实践提供有力的理论支撑。

The new Administrative Procedure Law has altered the concept of＂specific administrative act＂to＂administrative act＂.Therefore,the two-dimensional system of administrative behavior classification,that is the division between specific administrative act and abstract administrative act,will surely never exist.The concept of＂administrative action＂has become a legal concept,but it also brings many practical problems.Therefore,it is necessary to define the concept of administrative act in order to promote the in-depth study of the theory of administrative law in China and provide a strong theoretical support for judicial practice.
