论权利穷竭原则的本质——“知识产品权利分离说”之提出与解读

On the Essence of Exhaustion of Intellectual Property Rights Principle—— “Theory of Rights Separation in Intellectual Products” Being Put Forward and Explained

世界知识产品贸易中各国政策的冲突与知识产权立法的分歧,使权利穷竭这个陈旧的话题不断引起学界新的关注且众说纷纭。究其根源,在于权利穷竭的法理本质并未得到应有重视与必要统一。因此,有必要从回归知识产权的视角,在对权利穷竭的相关理论学说评析基础上,审视权利的初始分配正义,直面"权利穷竭"命题的局限,尝试提出"权利分离说",将知识产品上的知识产权、物权乃至于其他财产权同等重视,在客体、内容与效力等方面将其互相分离,以寻求同一财产对象上不同权利间和谐公平的共生共存之秩序,从而将"权利分离原则"上升为财产权法的共有原则。

The conflict of policies and legislation of different countries in the trade of international intellectual products makes educational circles constantly pay close attention to the outmoded subject of exhaustion of intellectual property rights and opinions are widely divided. Traced to its source, the essence of law theory of the exhaustion of rights principle hasn＇ t been attached due importance to and essentially unified. So, it＇ s necessary, from the visual angle of returning to intellec- tual property rights, to face frankly the pseudo proposition of ＂rights exhaustion＂, to put forward ＂rights separation theory＂ based on their correlative theoretic comments, after turning the attention back from intellectual property rights to the original distributive justice of rights. On the intellectual products, the intellectual property right, the real right and other property fight should be put on an equal footing, be separated from each other on the object, content, legal force and so on, in order to seek the fair and harmonious order of intergrowth and coexist on the same target.
