Interpretation of the Time Spirit of the Rule of Administrative Law

行政法治的精神实质受制于时代的发展和变化。行政法时代精神的解读既是一个行政法治实践问题,更是一个行政法哲学上的问题。如果能够从法哲学层面对行政法治时代精神做出科学解读,必然会对我国建设法治政府乃至于法治国家有所助益。在不同的历史条件下,行政法治有着不同的内涵和内涵上的合理性,随着行政法在复杂社会机制中的多元特性出现,不能简单地用某种单一价值来给当代行政法的正当价值进行定性,也就是说行政法的价值在当代是多元的或者复合性的。至少应当体现:宪法至上、行政过程理性化、行政的社会治理和司法最终裁判等方面的价值。

The spiritual essence of the rule of administrative law is subject to the development and changes of the times. The interpretation of the time spirit of the rule of administrative law is not only a question of the practice of the written law, but also a philosophical problem of administrative law. If we make scientific inter- pretation of the time spirit of the rule of administrative law from the aspect of legal philosophy,it is bound to be helpful to the construction of the government and the countries under the rule of law in our country. We think the rule of administrative law has the different connotation and the connotation rationality under different histor- ical conditions. With the multiple characteristics of the administrative law in the complex social mechanism, we can＇ t simply use a single value as the legitimate value of the contemporary administrative law. The value of ad- ministrative law is plural or compound in the contemporary world. At least it should conclude the value such as the supremacy of the constitution, the rationalization of the administrative process, the social governance of the administration and the final judgment of the judiciary.
