共享经济下网络平台的法律地位——以网约车为研究对象 被引量:124

On the Legal Status of Network Platform under Shared Economy——Taking the Online Car- hailing as the Research Object

摘要 网络平台是共享经济的基础,网约车是基于移动互联网技术和大数据技术搭建的一个相对封闭的个人对个人的客运市场,是一种新型的交通业态,网约车促成具有短暂且分散的供需意愿,是共享经济的体现,应归于一种准公共交通形态。网约车服务以私家车零工经济模式为主,满足了临时性的分散雇佣与就业问题,具有运营与非运营模糊以及法律关系复杂等特点;"野蛮生长"下的"四方协议"模式实现了网约车人车合一的经营,但却造成法律形式和经济实质之间的错配,造成网约车平台与乘客之间法律关系的虚化,认定网约车旅客运输合同的承运人角色,有利于保护乘客的合法权益,保障网约车健康发展。 Based on the mobile intemet technology and big data technology, we build a relatively closed peer - to - peer market, called transportation network vehicle. Transportation network vehicle Contribute to short and scattered 'willingness to supply and demand ,It is a new type of traffic system, It is the embodiment of Shared economy,it Is a quasi public transportation form. Private cars with odd jobs in economic models meet the temporary dispersed employment and the employment problem. Transportation network vehicle blurred the line between operations and the operations, and lead to complex legal relationship. Quartet agreement achieves the One car one business model, but it results in a mismatch between the legal form and economic substance, results in the false legal relationship between transportation network vehicle and passengers. In essence, between the platform and passengers set up the contract of carriage of passengers, we shall clear the carrier status of the network platform in order to protect the legitimate rights and interests of passengers, and its healthy development.
